REGULATIONS

  1. General

1. These Regulations specify the conditions for making purchases on the website www.modelik.pl that in individual cases shall be in writing negotiation;

1.2 In order to avoid errors when using the services of our shop and ordering, it is necessary to use one of the following browsers: Google Chrome, Internet Explorer, Opera - Mozilla, Firefox, etc.

1.3 The seller is the Wydawnictwo Modelik - Janusz Oles, based in Gryfino, Szczecinska 10, NIP 955-165-24-82, ID 811181614.

1.4 Prices given in offer are gross prices in Polish currency or alternatively in Euro (possibility of prices in euro applies only to payments made outside the Poland and with order to ship abroad). Prices in euros are "rigid" and were set at EUR 1 = PLN 4.00 and are not subject to exchange rate fluctuation

  1. Shopping, payment and delivery

2.1 All orders in our store are the ones with obligation to pay;

2.2 In accordance with art. 535 of the Civil Code, the seller agrees to transfer the property to the buyer of goods and give him the goods, and the buyer agrees to collect same and pay price to the seller;

2.3 Seller can check the goods and collect same personally at our headquarters in Gryfino on weekdays from 8.00 ~ 16.00;

  1. 4 The customer purchasing at a distance, who wishes to supply the goods through the Polish Post, is requested to send immediately after the bid an e-Mail or inform by phone:

       - full style (address) for shipment,

       - the choice of payment method: for domestic shipping the cash paid on delivery to postman or at the post office, or bank transfer. For parcels with order to send same abroad bank transfer - bank account number 87 1140 2004 3302 5555 9797 (mBank) or through PayPal, account: biuro@modelik.pl,

       - contact telephone number,

       - request of VAT invoice if any, together with the data for the invoice (otherwise receipt will be issued);

      Above does not apply to purchases from an online store if the customer’s data are already registered there.

Each customer choosing the method of prepayment, should make transfer within 7 days to: Wydawnictwo Modelik - Janusz Oles, account number: 87 1140 2004 0000 3302 5555 9797.

For orders with a value up to PLN 100.00, shipping cost PLN 15.00 will be added automatically.  For orders worth more than PLN 100.00 shipping costs to be covered by Wydawnictwo Modelik. For orders with delivery outside the Poland flat rate cost of delivery is always PLN 80.00 or EUR 20.00 (depending on which currency the customer chooses).

 

2.5 In the title of the payment should be given order number or the date and contents of the order, or other description allowing the identification of the order;

 

2.6 We try to ship every product within 1-4 working days since the payment is booked on our account  or from placing order when payment on delivery. Usually we dispatch by post twice a week on Tuesdays and Fridays. In accordance with applicable laws, delivery must be made not later than 30 days. Our standard is 1-4 days for shipping + 2-3 days for delivery, always accomplished by Polish Post. We, however, are not responsible for any delays in delivery arising from the functioning of the Polish Post. Shipments with the order to send abroad we dispatch as a registered priority letter (up to 2 kg) or as ordinary package by land-sea mail (if more than 2 kg). The delivery time depends on the type of the package and distance to the destination country.

2.7 Each shipment is carefully packaged and protected, but please check its condition at the time of receipt, and possible damage to the goods please notify to the supplier, which is required to write down the proper application protocol - please promptly report to seller any defects;

 

  1. Withdrawal from the contract

3.1 You have the right to withdraw from this contract within 14 days without giving any reason.

The deadline to withdraw from the contract expires after 14 days from the date on which you came into possession of the goods, or from the date third party (other than the payer) indicated by you came into possession of same.

 

To exercise the right of withdrawal you must inform us, ie. Wydawnictwo Modelik - Janusz Oles, Szczecinska 10, Gryfino 74-100, Poland tel/fax: +48 91-40-45-299; e-mail biuro@modelik.pl of its decision to withdraw from this contract by an unequivocal statement (for example the letter sent by mail, fax or e-mail).

 

You may use withdrawal form (which is available below), but it is not obligatory.

 

You can also fill in and submit the form to withdraw from the contract or any other unequivocal statement electronically from our website www.modelik.pl. If you use this option, we will send you at once an acknowledgment of receipt the notice of withdrawal from the contract on a solid medium (e-mail for example).

To keep the term of withdrawal, it is enough to send us information on exercising the right of withdrawal from the contract before the deadline to withdraw from the contract.

3.2 Effects of withdrawal from the contract

In case of withdrawal from the contract, we shall reimburse to you all payments received from you, including the cost of delivery of the goods immediately and in any event no later than 14 days from the date on which we are informed about your decision to exercise the right to withdraw from this contract. Reimbursement payments will be done using the same payment method that you used for the original transaction, unless you have expressly agreed alternative. Please send us returned items to: Wydawnictwo Modelik, Szczecinska 10, Gryfino 74-100, 10 immediately and in any event not later than 14 days from the date on which you told us about withdrawing from the agreement. The deadline is met if you send back the items before 14 days. You have to cover the  cost of returning the goods. Returned items must be secured for the shipping in a way that prevents damage and get back to us in the same condition in which they were delivered.

3.3 In accordance with art. 34 of the Law on the Rights of the Consumer:

  1. The customer is required to send goods back to the seller immediately, but not later than 14 days from the date of withdrawal from the contract; To comply with this deadline simply return the items before its expiry.
  2. The customer covers the cost of returning the goods (unless there is a case specified in Art. 34 paragraph. 3 of the Law on the Rights of the Consumer);
  3. The customer is responsible for the reduction in the value of goods as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of goods, or damage when returning as result of careless and inadequate protection of the goods by customer, which for the publishers of cardboard models is particularly important.
  4. Complaint

4.1 Complaints should be directed to: Wydawnictwo Modelik - Janusz Oles, Szczecinska 10, Gryfino 74-100, Poland, tel/fax: + 49 91 40 45 299; e-mail biuro@modelik.pl.

  1. 2 In the complaint notification please indicate whether the complaint is based on the Law on the Rights of the Consumer, on the basis of warranty or guarantee and also please describe, if possible, defect of the product (photograph, scan). The notification must include:
    - notification of defects (faults),
    - claim
    - where the answer have to be sent (of course if the customer still wants to keep the method of shipping);

 

4.3 We will address each complaint immediately, but no later than within 14 days

4.4 Warranty cover offers, in the content of which the seller made it clear that the special offer is covered by a guarantee, which does not affect (not limits) to the other rights of each customer.

      The customer retains the right to complain of warranty - if is not a consumer - or of Consumer Laws - if is a consumer.

  1. Confidentiality and privacy.

5.1 Wydawnictwo Modelik - Janusz Oles is the owner of all the pictures and descriptions in our offers, and therefore it is forbidden to copy them without prior approval. Basically we give our approval to all parties interested, but we want to maintain control over perosns who uses this. We reserve the right to refuse.

5.2 Any data received from the buyer will be used solely for the purpose of the contract, and each customer has the right to inspect them.

  1. The obligation to provide information about energy consumption by energy-using products.

  1. Final provisions.

7.1 Each customer has the right to individual negotiation of individual provisions/conditions of purchase in the way of negotiations of the very offer  (in writing)

7.2 These regulations seller sends to the buyers electronically as a PDF, and provides a copy to save the contents on the disk or external media;

7.3 In matters not covered by these regulations, shall be governed rules of the Civil Code (and the Code of Civil Procedure), and in relation to the consumers also provisions of consumer laws;

7.4 In order to implement the agreement, the seller is forced to use the personal data provided on the basis of article 23 act 1 point 3 of the Act of 29 August 1997 about protection of personal data. After the completion of the contract, data will be immediately removed or permanently modified;

  • Performing an obligation under the Act on the Protection of Personal Data we inform about contents of the art. 24:

1.In the case of collection of personal information from the person to whom they relate, the data controller is obliged to inform that person about:

- full style and name of its registered office and if the controller is a natural person - the place of his residence, name and surname

- the purpose to collect the data, in particular the well-known to him during the provision of information recipients or categories of recipients,

- the right of access to their personal data and correct,

- voluntary or obligation to provide the data, and if such an obligation exists, its legal basis.

2. Regulation of act 1 shall not apply if:

   - provision of other law allows the processing of data without revealing the actual purpose of the collection,

   - the person whom the data relates has the information referred to act 1;

7.6  In the meaning of the Act of February 4, 1994  on copyright and related rights, it is prohibited to copy our products in terms of sheets with drawings to cut-out, texts (descriptions, instructions for building), covers (illustrations, photographs) and other copyright materials. Simlutaneously  we warn about the responsibility for violations of the rules of law arising out of the above legal act;

7.7 In accordance with Article 173 and 174 of the Telecommunications Law we inform, that the data contained in cookies during the use of the website online store are collected automatically. Cookies are computer data, in particular text files stored in the user's terminal equipment for the use of websites. These files allow the user to identify the device and properly display the web page tailored to their individual preferences.

Usually cookies contain the name of the website from which they originate, their storage time on the terminal equipment and a unique number. Most often switching on the cookies is necessary to use the store, shopping cart and the customer panel, because session mechanism works on its basis.

The shop stores information in the cookies about id session and visits in the shop. Data collected by using cookies can only be collected in order to perform specific functions for the user. The software  not designed for web browsing allows by default placing cookies at the final device.

The settings can be changed in such a way as to block cookies support in the web browser settings.

Detailed information about the possibilities and ways of handling cookies are available in the web browser settings. Cookies can be always removed from the computer, and the browser can be also set in that way, that you do not let the above files - for this purpose use the web browser settings (eg. by typing in the search phrase "privacy settings for the browser XYZ").
